Can I Establish A Custody Arrangement Without A Formal Agreement?

Dear Attorneys,

My husband knows the divorce papers are coming, and he already wants to establish a custody arrangement for the kids. I am really not comfortable because I don’t think he will abide by my rules. What can I do to make sure that the schedule I make is followed?

We definitely understand why coming up with a set parenting time schedule is important. The truth is, you can negotiate an arrangement and hope that it is followed, but without having a formal agreement entered with the court there would be no true way to ensure it’s abided by.

Once your divorce papers have been served and filed with the court, the first thing you should get to work on is a temporary agreement that outlines visitation with the children to be entered right away. This way, you have a valid court order and the ability to alert the court should your husband decide to deviate from that order.
