I’m in the Middle of My Divorce and Asked for Lifetime Alimony, My Attorney says that’s not Common anymore, Is that true?

Dear Attorneys,

I’m in the middle of my divorce and I asked for lifetime alimony. My grandma got it when she got divorced, so why can’t I? My attorney said that it’s not as common anymore. Is that true?

Dear Lifetime,

It is true that lifetime alimony is not as common as it once was. It does not mean that it is never awarded, but, there is now more caselaw regarding alimony and the statute is more defined. Very often, a party who was the lower-earner, or, often, a stay-at-home-parent, will get alimony in a divorce case. However, it is generally for a set duration, rather than “for a lifetime.” You should ask your attorney why he or she does not believe that you will receive it and see if you can agree upon a substantial timeframe instead.
