What If I Don’t Agree With Extracurricular Activities During COVID-19?

Dear Attorneys,

_According to my divorce agreement, any and all extracurricular activities for the kids are supposed to be mutually agreed upon. I currently do NOT agree with any right now due to COVID-19. Do I have to agree? I don’t want to be the bad guy, but I just feel like it’s not safe right now for my children to participate in extracurricular activities. _

We hear you, and we understand your position. The real issue here is not whether or not you have to agree (you don’t), it’s whether or not you and your co-parent can discuss this issue together and reach a resolution. Neither parent should be the bad guy. No parent is ever required to consent to an extracurricular activity. It’s just that, in general, neither parent should unreasonably withhold consent. The current health pandemic is a valid concern that effects many families. If you cannot reach an agreement, and neither party has final decision-making authority, then you may need to consider whether or not this is something that needs to be brought to court.
