Why Can’t I Include All of My Concerns In My Divorce Complaint?

Dear Attorneys,

I currently have an attorney for my divorce. They sent me a drafted Complaint and it doesn’t address all of my concerns. I asked them to add the rest of my concerns in, but they told me that they could not all be included. How can that be? Is this normal?

We are sorry to hear about your forthcoming divorce. While we understand your concerns, your attorney is actually correct. The Complaint is used to set forth jurisdictional criteria and itemize your main categories of concerns (in a divorce, this is different in civil litigation). The details of outstanding issues will be specified in your final agreement, and possibly temporary agreements along the way.

That said, we have not directly addressed your concerns with you, nor have we seen the drafted Complaint. There may be valid concerns of yours that could be included in your Complaint, such as the need to itemize alimony if you are seeking it.
